Office of the Commonwealth’s Attorney – Obtaining Discovery
The Office of the Commonwealth’s Attorney is committed to fair and ethical prosecution. While the Rules of the Supreme Court of Virginia and relevant case law establish minimum discovery requirements, our office routinely exceeds these standards to promote transparency and fairness.
Discovery Procedures:
- Individual prosecutors exercise discretion regarding the scope of discovery in each case.
- The Office of the Commonwealth’s Attorney generally provides open file discovery, subject to a protective order that restricts the dissemination of certain sensitive materials.
- Once a case is set for trial, a paralegal will contact defense counsel to coordinate the protective order and discovery process.
To expedite discovery, defense counsel may proactively submit a completed and signed discovery protective order to the appropriate email address listed below:
